For customers on quarterly or monthly service plans, we guarantee our work between scheduled services. If pest activity returns, we will re-service at no additional charge. This guarantee does not apply to:

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, PEST ME OFF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO OUR SERVICES OR THESE TERMS.
8.2 Total Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO PEST ME OFF IN THE 12 MONTHS PRECEDING THE CLAIM, OR $1,000, WHICHEVER IS GREATER.
8.3 Property Damage and Insurance
Pest Me Off carries general liability insurance for property damage caused by our negligence during service. Claims for property damage must be reported within 48 hours of service. We are not liable for:

You may cancel pest control services at any time by providing 30 days written notice to info@pestmeoff.com or (972) 866-4720. If you cancel a quarterly or annual service plan, you may be responsible for any outstanding balance or early termination fees as specified in your service agreement.
13.2 Termination by Pest Me Off
We reserve the right to refuse or discontinue service to any customer for any reason, including:

Upon termination, you remain responsible for all outstanding charges. The following sections survive termination: Sections 5 (Intellectual Property), 7 (Warranties), 8 (Limitation of Liability), 9 (Indemnification), 14 (Dispute Resolution), and 16 (General Provisions).

14.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms, our services, or our relationship with you shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as modified by these Terms.

14.3 Costs and Fees
Each party shall pay their own attorney fees and costs, unless the arbitrator awards fees to the prevailing party. Pest Me Off will pay all AAA filing and arbitrator fees for claims under $10,000. For claims over $10,000, fees are split equally unless otherwise required by law.
14.4 Class Action Waiver
YOU AND PEST ME OFF AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CONSOLIDATED PROCEEDING. THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY CLAIMS TO BE ARBITRATED OR LITIGATED ON A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS.
14.5 Exceptions to Arbitration
Either party may bring an individual action in small claims court (for claims within the court’s jurisdiction) or seek injunctive relief in court for intellectual property infringement.
14.6 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice within 30 days of first using our services to the address in Section 14.1. Your opt-out notice must include your name, address, and clear statement that you wish to opt out of arbitration. Opting out does not affect any other terms.
14.7 Waiver of Jury Trial
YOU AND PEST ME OFF WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY. You are instead electing that all disputes be resolved by arbitration under this agreement. If arbitration is found invalid, you and Pest Me Off waive any right to jury trial for any litigation in court.
14.8 Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any litigation (if arbitration does not apply) must be brought in state or federal courts located in Collin County, Texas. You consent to personal jurisdiction in Texas courts.
Pest Me Off, LLC is a licensed pest control operator in the State of Texas. We comply with all applicable federal, state, and local laws and regulations governing pest control services, including:

16.1 Entire Agreement
These Terms, together with our Privacy Policy and any written service agreement you sign, constitute the entire agreement between you and Pest Me Off regarding our services. These Terms supersede any prior agreements or representations.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Pest Me Off.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Pest Me Off may assign these Terms in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section is void.
16.5 Independent Contractor
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Pest Me Off. Our technicians are employees or contractors of Pest Me Off, not your agents or employees.
16.6 Force Majeure
Pest Me Off shall not be liable for delays or failures in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, weather conditions, government actions, strikes, equipment failures, or supply shortages.
16.7 Electronic Communications
You consent to receive communications from Pest Me Off electronically, including via email, text message, website notices, and our mobile app (if applicable). Electronic communications satisfy any legal requirement for written communications.

- Insect Control: Ants, roaches, spiders, scorpions, wasps, mosquitoes, fleas, ticks
- Pest Exclusion: Sealing entry points to prevent future infestations
- Free Estimates: No-obligation property inspections and quotes
1.2 Service Area

1.3 Service Appointment and Access

- Cash or check (with approved credit)

- Late fees of 1.5% per month (or maximum allowed by law)
- Suspension of service until account is current
- Referral to collection agency (customer responsible for collection costs)
- SMS/Text Message Terms
3.1 Consent to Text Messages
By providing your mobile phone number to Pest Me Off, you expressly consent to receive text messages (SMS/MMS) from us, including:
- Appointment confirmations and reminders
- Service notifications and updates
- Technician arrival notifications
- Payment receipts and billing reminders
- Pest prevention tips and seasonal alerts
- Promotional offers and special discounts (with your consent)
- Service satisfaction surveys
3.2 Message Frequency and Charges
- Frequency: Message frequency varies depending on service schedule and your preferences. You may receive up to 8 messages per month for active service customers.
- Charges: Message and data rates may apply as determined by your mobile carrier. Pest Me Off does not charge for text messages, but your carrier’s standard rates apply.
- Carriers: Messages are supported on major carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.
3.3 Opt-Out and Help
- STOP: Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any text message to opt out of all text messages from Pest Me Off. You will receive one final confirmation message.
- HELP: Reply HELP or INFO to any text message for assistance, or contact us at (972) 866-4720.
- Opt-Back-In: After opting out, you may opt back in by texting START or by contacting us directly.
3.4 Privacy and Data

- Service Guarantees and Warranties

For customers on quarterly or monthly service plans, we guarantee our work between scheduled services. If pest activity returns, we will re-service at no additional charge. This guarantee does not apply to:
- One-time or initial services (unless specified)
- New pest infestations different from original treatment
- Pest activity caused by customer actions or property conditions
- Accounts with past-due balances
7.2 Limitation of Warranties
THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- Services will completely eliminate all pest activity immediately or permanently
- Our website will be uninterrupted, error-free, or secure
- Results will meet your specific expectations
- All pest issues will be resolved in a single treatment

- Indemnification
You agree to indemnify, defend, and hold harmless Pest Me Off, LLC, our officers, employees, technicians, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from:
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your failure to provide accurate information or follow instructions
- Your misuse of our services or website
- Third-party claims related to your property or actions

- Judgment on the arbitration award may be entered in any court of competent jurisdiction
14.3 Costs and Fees
Each party shall pay their own attorney fees and costs, unless the arbitrator awards fees to the prevailing party. Pest Me Off will pay all AAA filing and arbitrator fees for claims under $10,000. For claims over $10,000, fees are split equally unless otherwise required by law.
14.4 Class Action Waiver
YOU AND PEST ME OFF AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CONSOLIDATED PROCEEDING. THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY CLAIMS TO BE ARBITRATED OR LITIGATED ON A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS.
14.5 Exceptions to Arbitration
Either party may bring an individual action in small claims court (for claims within the court’s jurisdiction) or seek injunctive relief in court for intellectual property infringement.
14.6 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice within 30 days of first using our services to the address in Section 14.1. Your opt-out notice must include your name, address, and clear statement that you wish to opt out of arbitration. Opting out does not affect any other terms.
14.7 Waiver of Jury Trial
YOU AND PEST ME OFF WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY. You are instead electing that all disputes be resolved by arbitration under this agreement. If arbitration is found invalid, you and Pest Me Off waive any right to jury trial for any litigation in court.
14.8 Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any litigation (if arbitration does not apply) must be brought in state or federal courts located in Collin County, Texas. You consent to personal jurisdiction in Texas courts.
- Licensing and Compliance
Pest Me Off, LLC is a licensed pest control operator in the State of Texas. We comply with all applicable federal, state, and local laws and regulations governing pest control services, including:
- Texas Structural Pest Control Act
- EPA pesticide regulations and product labeling requirements
- OSHA safety standards
- Texas Department of Agriculture licensing requirements
All technicians are licensed or work under the supervision of licensed pest control operators. License information is available upon request.
- General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any written service agreement you sign, constitute the entire agreement between you and Pest Me Off regarding our services. These Terms supersede any prior agreements or representations.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Pest Me Off.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Pest Me Off may assign these Terms in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section is void.
16.5 Independent Contractor
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Pest Me Off. Our technicians are employees or contractors of Pest Me Off, not your agents or employees.
16.6 Force Majeure
Pest Me Off shall not be liable for delays or failures in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, weather conditions, government actions, strikes, equipment failures, or supply shortages.
16.7 Electronic Communications
You consent to receive communications from Pest Me Off electronically, including via email, text message, website notices, and our mobile app (if applicable). Electronic communications satisfy any legal requirement for written communications.
